Distracted Trucking Driver Accident Settlement

Our client, a 24-year-old young woman, was traveling northbound on Highway 281 when a tractor-trailer driven by a distracted driver drove through an intersection with the highway without stopping or yielding. This lack of caution, unfortunately, resulted in the tragic death of a young woman who had a bright future ahead of her.

Attorneys Shalimar Wallis and Kelsey Abbey along with their team came to the aid of the client’s family to help them achieve justice in a situation that should never have happened. Their unrelenting tactics resulted in the case settling and although that does not replace the life that was lost, it helped hold the proper party accountable for this tragic occurrence.

Distracted Driving Auto Accident Settlement

There are three types of distracted driving – visual (taking your eyes off the road), manual (taking your hands off the wheel), and cognitive (taking your mind off driving). NHTSA statistics show a significant increase in the likelihood of injury or death due to vehicle collisions when a driver is distracted. Our client was a victim of a distracted driver which resulted in significant injuries.

The defendant driver, who has a history of bad driving, failed to see the car in from of him which resulted in a rear-end collision. Our team of attorneys, Rebecca Page, Jennifer Neal, and Lance Kimbro, along with their team protected our client’s rights and made sure that justice was delivered.

It is important to hold companies accountable for hiring bad drivers, especially when they are behind the wheel of a large commercial vehicle. Our team at Watts Guerra has and will continue to fight for this mission to increase safety on the road. Great job everyone!

Inattention behind the wheel accounts for 18% of all accidents in the state of Texas, causing nearly 100,000 crashes annually[1]. Momentarily taking your eyes off the road to adjust the radio, reply to a text message, or browse through social media compromises your ability to safely operate a motor vehicle. Federal Motor Carrier Safety Administration has banned drivers of commercial motor vehicles from texting.
Texting means manually entering text into, and/or reading text from an electronic device.
There are harsh fines and penalties for those commercial motor vehicle drivers caught texting and driving.

Why Do Truck Drivers Get Distracted?

Truck drivers have a difficult job and many make their tasks exponentially more difficult by allowing themselves to get distracted while driving their 60,000-pound tractor-trailer at highway speed. Minor distractions like eating or changing the radio can lead to major problems, but drivers who use an in-cab computer or their mobile phone while driving are playing a deadly game. Companies that refuse to eliminate a driver’s use of technology while driving are guilty of negligence.
